Press Release:
CES Credit Union Savings Sweepstakes Winner Awarded $5000

A Mount Vernon (Ohio) youth was rewarded on Valentine’s Day for her family’s savings habits with a $5000 sweepstakes award presented by CES Credit Union. Twelve year old Lisa Devore, along with her father, Darrell Devore of Mount Vernon, were notified yesterday that they are the first recipients of the “Wealth Builder” Savings Sweepstakes, an innovative program started by CES Credit Union to reward and encourage savings among credit union members and the community as a whole.

Every dollar saved in a CES Credit Union Base Savings Account counts as an entry into a monthly sweepstakes drawing where one random winner is awarded $5000. This month (February) is the first of many sweepstakes prizes CES Credit Union plans to award over the next year and beyond. The Devore’s were notified Thursday by Kelly Schermerhorn, CEO of CES Credit Union, that they were the winners of the $5000 grand prize.

“I am really happy”, said Lisa, still in shock from the announcement. She is a seventh grader at Mount Vernon Middle School. Her parents started the savings account for her when she was just one year old. Her father, Darrell, said he “still couldn’t believe it”, and said they plan to use the money for Lisa’s college.

This sweepstakes program is one of the first of its’ kind offered by any financial institution in the nation. Schermerhorn said CES Credit Union has committed to award $5000 every month through the rest of 2008 and probably longer. The “Wealth Builder” Savings Sweepstakes is designed to “increase awareness of the importance of savings, and that every dollar saved does help build independence and stability for the accountholder. We hope to remind everyone to save at least a few dollars every week, especially when we have placed a large incentive there.”  The sweepstakes is designed to encourage savings, even if it is just a little more every month, because “they win either way, either through the sweepstakes, or just having a bigger savings nest egg of their own. It helps build wealth for our members and our community” explained Schermerhorn.

The current annual percentage yield for the CES Credit Union base savings account is 1.00%, with a $5 minimum balance requirement and six free withdrawals per month.

There is no purchase required for the sweepstakes, and the details are available on the credit union’s website at www.cescu.com

Official Rules and Regulations
of the

CES Credit Union
Wealth Builder Sweepstakes

SPONSOR. This sweepstakes is sponsored by CES Credit Union, Inc., Mount Vernon, Ohio. Sponsor reserves the right to cancel the Sweepstakes at any time and substitute another promotion in its place. Sponsor is not responsible for printing in these official rules.  The Sponsor further reserves the right to modify the rules of the Sweepstakes in any way at any time, as long as reasonable notice is given.

NO PURCHASE NECESSARY TO ENTER OR WIN. Each full (available) dollar on deposit in a CES Credit Union Base (Share) Savings Account at the closing time on the final day of business for a sweepstakes drawing time period (which may vary), such as a calendar month, constitutes an entry into the sweepstakes for the duration of the sweepstakes.  Other CES Credit Union account balances are not included in this promotion. Dividends (also commonly known as “interest”) paid to the account monthly will also be considered toward the calculation of the amount of eligible entries. For example, an owner(s) of the CES Credit Union Base (Share) Savings Account may have a collected sweepstakes drawing time period-ending balance of $225.25 and have earned $1.50 in dividends for the period, so $226.75 is used to calculate the number of eligible entries. Using this example, 226 entries in the sweepstakes would be considered for sweepstakes for that sweepstakes drawing time period. Some items for deposit in the Base Savings Account may not be considered “available” or “collected” (as defined in the T-I-S and Share Draft Collection Policy) and thus are not considered as an entry for this sweepstakes, as determined by the policies and management of the credit union. This sweepstakes is void where prohibited, taxed or otherwise restricted by law, and is subject to all federal, state and local laws. Each owner of the account is eligible to an equal share of the sweepstakes winnings if that account generates the winning entry.  This sweepstakes begins on February 1, 2008 and may end without notice.  Mail-in entries are accepted, and are described below. No substitution or transfer of prize is permitted.

WHO CAN PARTICIPATE? This Sweepstakes is open to all legal residents of the United States and District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses, Alaska and Hawaii (void in Puerto Rico). Participation in this Sweepstakes constitutes entrant's full and unconditional acceptance of these Official Rules, and acknowledge full acceptance of the terms of the Privacy Statement of CES Credit Union.  Each potential sweepstakes winner (or, if a minor, the winner's parent or legal guardian) must execute an Affidavit of Eligibility/Release of Liability/Publicity Release/Prize Acceptance Form within 15 days of notification. Non-compliance/return of prize notification as undeliverable will result in disqualification and selection of an alternate winner.

If the sweepstakes entrant is between the ages of 0 and 17:  If a participant's date of birth translates to an age between 0 and 17 at the time, and the child is a sweepstakes winner on any level, his/her parent and/or legal guardian will be informed as soon as possible and before the child is informed, and the parent/guardian will be presented with the official rules of this sweepstakes either in person, by U.S. mail or by e-mail. Steps have been taken to ensure that personally identifiable information for participants under the age of 13 collected for this Sweepstakes is used only by the Sponsor as described herein and is secured against unauthorized access. Sponsor will not use such information in violation with the Children's Online Privacy Protection Act of 1998 or give any of this information to any third parties unless required to do so for legal reasons, such as a court order or regulatory agency rule, or if permitted to do so under the provisions of the Children's Online Privacy Protection Act of 1998.

“OPT-OUT OPTION” CES Credit Union accountholders may opt-out of the sweepstakes by submitting a written request to opt-out of the CES Credit Union Access to Savings Sweepstakes and submitting that written request with your name, age, complete address, including zip code and phone number (account numbers are also helpful) legibly printed to any CES Credit Union office or by mail (with sufficient postage) to CES Credit Union Sweepstakes Opt-Out, PO Box 631, Mount Vernon, Ohio 43050. Accountholders names will not be disclosed without the written or implied consent of the accountholder. Any winning entry that is also an accountholder of CES Credit Union that does not wish to comply with the terms of the sweepstakes may refuse or “opt-out” of the terms of the sweepstakes and thereby forfeit any compensation or winnings. For multiple owners of an account that produces a winning entry, all (living and competent legal) account owners must comply with the terms of the sweepstakes, or thereby forfeit any compensation or winnings for all of the multiple owners of the account.

WHO IS NOT ELIGIBLE TO PARTICIPATE? Employees and all elected or appointed volunteers and their immediate families (parents, brothers, sisters and children including biological and/or adopted relationships) of the Sponsor, CES Credit Union, Inc. and any subsidiaries and affiliated businesses and their advertising and promotion agencies are not eligible to enter or win.

HOW DO I ENTER? There are two methods to enter the sweepstakes.

ENTRY BY DOLLAR ON DEPOSIT METHOD: Enter through participation in the CES Credit Union cooperative by considering each full dollar of eligible funds deposited into the CES Credit Union Base Savings Account as an entry (described previously).  Accountholder must meet all CES Credit Union membership eligibility requirements.

MAIL-IN METHOD: Complete an official entry by printing your name, age, complete address, including zip code and phone number on a 3 1/2 " x 5" card and mail it with first class postage affixed to: CES Credit Union Access to Savings Sweepstakes, Post Office Box 631, Mount Vernon, Ohio 43050. Mail-in entries must be legible and submitted in original hand-printed form. Each entry must be mailed separately and have sufficient postage. Entries mechanically reproduced or made in any fashion are void. Sponsor is not responsible for lost, late, misdirected, postage due, damaged, mutilated, illegible or incomplete entries. There is a limit of one entry by mail per day. All entries by mail must be received by either the last business day of the sweepstakes drawing time period for CES Credit Union, or the last regular U.S. Mail day of operation for the sweepstakes drawing time period, whichever is earlier, to be eligible as an entry for the sweepstakes for that sweepstakes drawing time period. Entries are not “carried-over” to the next sweepstakes drawing time period. The duration of the sweepstakes is not certain, and may end without notice.

All entries become the property of the Sponsor and will not be acknowledged or returned. False or deceptive entries or acts will render the entrant ineligible.

ONE OR MORE SWEEPSTAKES WINNERS PER SWEEPSTAKES DRAWING TIME PERIOD. During the duration of the sweepstakes, numerous lucky Sweepstakes Prize Winners will receive specially selected prizes. Approximate retail or cash value may range in price up to $10,000 for each sweepstakes drawing time period the sweepstakes is operating. Total value of all prizes will be determined by the prize values and the number of sweepstakes drawing time periods the sweepstakes is in operation.

Winner acknowledges that except and to the extent that the Sponsor cannot by law exempt itself from responsibility or liability, the Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee described herein; including, but not limited to, its quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed, and the winner will accept the prize "as is".

Prizes (if not cash or equivalent) cannot be assigned, transferred, exchanged or redeemed for cash. Prize acceptance constitutes permission (except where prohibited) to use winner's name and likeness for publicity purposes without additional compensation.

HOW DO I WIN? During the duration of the CES Access to Savings Sweepstakes, eligible entries received through the ”Entry by Dollar on Deposit” will be combined with the eligible mail entries received, to create the entry pool. Prize Winners will be selected on approximately the third to fifth business day following the end of a sweepstakes drawing time period (such as a calendar month) for the duration of the sweepstakes by a random drawing conducted by Condit and Associates (whose address is 27 East Home Street, PO Box 608, Westerville, OH 43081), an Ohio-based independent auditing firm and an official judging organization, whose decisions regarding all aspects of the Sweepstakes shall be final and binding. The odds of winning a prize will be determined by the number of entries received during the sweepstakes drawing time period (which may vary). Odds of winning are equal regardless of the method of entry.

If a winner declines to accept a prize, or in the event that a prize or prize notification is returned as undelivered, the winner will be disqualified and the Sponsor may elect, at its own discretion, to select an alternate winner. By participating, entrants release the Sponsor, its parent, subsidiaries, affiliated businesses, its advertising and promotion agencies and the officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named or described) for injuries, damages or losses to persons and property which may be sustained in connection with receipt, enjoyment, ownership or use of the prize, and (except residents of Tennessee) winner grants permission to Sponsor to use winner's name, age, city, state, photograph or likeness for advertising and promotional purposes without additional compensation or approval (where lawful). For names of winners, send a separate, stamped (Vermont residents may omit return postage), self-addressed No. 10 envelope to CES Credit Union Sweepstakes Winners, PO Box 631, Mount Vernon, Ohio 43050.

DISPUTES Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Ohio; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Ohio or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Ohio.
